Department Overview:

The Legal Department at TD Bank Group is comprised of corporate/commercial and litigation lawyers with varying areas of expertise tailored to meet the legal needs of the various business units of TD Bank Group. The Legal Department is committed to delivering to its internal business clients the highest level of expertise, service, responsiveness and flexibility. Our lawyers identify emerging client opportunities, provide prompt and informed legal advice and produce tangible results that implement creative solutions.

The Account Recovery Services Group is a team within the Legal Department's Canadian Disputes and Investigations unit. The Account Recovery Services Group supports the Canadian Customer Assistance business at TD Bank Group by providing advice on collections matters and litigation and real estate services which are integral to the recovery of Bank funds on credit products.

Job Accountabilities:

In this Counsel, Disputes role for the Account Recovery Services team, you will join a dynamic and collegial team of legal professionals in a fast-paced environment, delivering quality services to our client, the Canadian Customer Assistance group.

Your primary duties will include:

  • Managing external counsel in all aspects of litigation at all levels of court in Ontario and other provinces to develop and implement strategy for the resolution of litigation (with a focus on secured and unsecured recoveries, small business banking and commercial recoveries, auto finance, collection agency matters and bankruptcy and insolvency files

  • Identifying enforcement opportunities as well as key legal risks and mitigation strategies, while ensuring awareness among relevant stakeholders and other members of the TD Legal team

  • Providing best in class litigation advice that is integrated with the strategies and objectives of the business and consistent with the enterprise wide risk policy

  • Providing advice to other members of the Legal Department and businesses across TD with respect to contractual interpretation and drafting, pre-litigation dispute resolution and litigation risk analysis

  • Providing regular oral and written to senior members of the Litigation Department and other control groups, business executives and various Risk Committees

  • Providing guidance and training to business and Legal partners through presentations on best practices, developments in the law, collection-related regulations, litigation processes and emerging risk areas

  • Supporting development and/or implementation of policies, procedures and solutions that mitigate risk and enable the achievement of business/enterprise priorities

  • Critically analyzing case plans, budgets and legal invoices from external law firms across the country

  • Actively listening to phone calls involving customers and TD staff members or collection agents to ensure compliance with applicable laws

  • Reviewing and advising on a myriad of diverse customer complaints (Cares and Senior Customer Complaints Office)

  • Working closely with control groups such as Governance, Compliance, Risk, Privacy, Fraud, etc. and building and maintaining positive working relationships with these partners by effectively communicating and regularly sharing information, learnings and knowledge

  • Contributing to high priority special projects and other Legal Department initiatives

  • Attending meetings with the Canadian Bankers Association (CBA) on proposed legislative amendments and communicating updates to appropriate business units and the Legal Department

  • Reviewing and revising legal documents prepared by internal Law Clerks, Legal Assistants and Business Analysts

  • Contributing to the preparation of regular financial reporting metrics

Specific Educational Requirements / Accreditations:

  • Law degree from an accredited law school and qualified to practice law in Ontario.

Other Qualifications / Skills / Experience:

  • Ideally, possess four or more years of post-call litigation experience working at a major law firm or in-house

  • Superior knowledge of Ontario's Rules of Civil Procedure and Rules of the Small Claims Court is desired

  • Knowledge of mortgage enforcement and bankruptcy and insolvency law is preferred but not required

  • Experience using the Techcom system is an asset but not required

  • Ability to identify problems and barriers and effectively implement solutions to advance business strategy

  • Ability to operate with creativity and innovation and a desire to seek different perspectives and new ideas

  • Demonstrate good judgment, leadership and relationship management skills

  • Strong analytical, problem solving, collaboration and team building skills are required along with sharp attention to detail

  • Flexibility to quickly adapt to changing and ambiguous initiatives or requirements

  • Ability to work effectively across and throughout the enterprise with teams and independently

  • Ability to multi-task and operate on a day-to-day basis with limited supervision is critical

  • Ability to communicate complicated legal issues in a clear, succinct and effective manner to business clients and other professionals, both verbally and in writing

  • Bilingualism would be considered an asset but is not mandatory

  • Strong technology aptitude including (i) proficiency with standard office software and ability to learn and apply new technologies in the work environment and (ii) capacity to understand current and emerging technologies in the industry and how they affect business objectives
